Terms and Conditions of Purchase and Sale

1. VALIDITY OF THE TERMS OF SALE

1) The terms of purchase and sale of goods between the buyer (later on as Buyer) and the online store (later on as online store kaisakuunlad.ee) kaisakuunlad.ee (register code: 12845470, phone: +372 5390 2002, account no. EE342200221061938110).

2) In addition to these terms and conditions, the legal relations arising from the purchase of products from the kaisakuunlad.ee online store are regulated by the Law of Obligations Act (hereinafter VÕS), the Consumer Protection Act (hereinafter TKS) and other legislation in force in the Republic of Estonia.

3) The online store kaisakuunlad.ee reserves the right to make changes in the terms of sale. These changes are reflected on the website www.kaisakuunlad.ee.

2. PRICE INFORMATION

1) The goods are sent to the Omniva or Itella Smartpost parcel machine according to the price list of the service provider. Goods that cannot be sent to the parcel machine are sent by courier. Read more about delivery in section 6 and under “Delivery“.

2) If the order has been submitted before the conditions of sale or prices have been changed, the conditions valid at the time of placing the order shall apply to the legal relations between the Buyer and the online store kaisakuunlad.ee.

4) The online store kaisakuunlad.ee reserves the right to make changes in sales prices. These changes are reflected on the website www.kaisakuunlad.ee.

5) All prices are in euros.

3. METHODS OF PAYMENT

1) On kaisakuunlad.ee it is possible to pay with Swedbank, SEB, Luminor, LHV, Coop Pank and PocoPay bank links.

2) All payments are made in euros and deducted from the payer’s account in euros.

3) Payments of bank links are mediated by Maksekeskus AS on the basis of an agreement.

4) The online store is the processor of personal data. The online store forwards the personal data necessary for making payments to the authorized processor Maksekeskus AS.

4. PLACING AN ORDER

1) Add the desired products to the shopping cart.

2) To place an order, click on the “PAY” link in the shopping cart

3) On the ordering page, fill in the required data fields correctly, because from the accuracy and correctness of the provided information will depend how fast and smooth the delivery of the goods is and the subsequent possible settlement of disputes and claims. When registering a customer account, information about it will be sent to the e-mail address indicated in the data.

3) Indicate that you have read and agree to the Terms of Sale and place an order by clicking on the button with the writing.

4) You will be displayed the bill for payment. You can view your invoice at any time by logging in to your client account. The invoice will also be sent to the e-mail address indicated in the Customer’s data.

5) Orders placed in the online store are processed on working days (Mon-Fri 10.00-18.00). If the order is submitted on Friday after 3 pm, the order will be placed the following Monday.

5. ENTRY INTO FORCE OF THE SALES AGREEMENT

1) With the Goods Sales Agreement, the online store kaisakuunlad.ee is obliged to hand over the existing Goods or the Goods acquired by the online store kaisakuunlad.ee to the Buyer and enable the transfer of ownership to the Buyer, the Buyer is obliged to pay the online store kaisakuunlad.ee and accept the Goods.

2) The sales contract enters into force after the payment made by the Buyer is received in the bank account of the online store kaisakuunlad.ee

6. DELIVERY

1) After the sales contract enters into force, the online store kaisakuunlad.ee guarantees the delivery of the order to the Buyer and hands it over to the company’s logistics partners for delivery.

2) The delivery terms indicated on the e-store website are valid from the moment the order amount is received on the online store kaisakuunlad.ee bank account.

3) In order to deliver without delay, care must be taken and true and valid data must be provided when entering the delivery data when placing an order.

4) Kaisakuunlad.ee online store is not responsible for delays in the delivery of goods if the goods have been handed over to the logistics partners on time, but the delay in delivery is due to circumstances which online store kaisakuunlad.ee could not influence or foresee.

5) Delivery method – The goods will be sent to the Omniva or Itella Smartpost parcel machine closest to you all over Estonia. It is also possible to pick up the goods yourself at the address Tallinn, Õismäe tee 181 (by prior arrangement).

We usually ship in country (Estonia) orders within 3-5 working days, the day after the payment is received, but not later than within 7 working days. Sending a parcel all over Estonia (Payment on receipt at a parcel machine).

7. RIGHT OF RETURN

1) After receiving the order, the Buyer has the right to withdraw from the contract concluded in the online store within 14 days. If the goods are defective or do not comply with the product description on the kaisakuunlad.ee website, the withdrawal costs will be paid by the online store kaisakuunlad.ee. In case of withdrawal from the contract, kaisakuunlad.ee will pay the initial postage related to the return of the goods.

2) Upon receipt of the goods, make sure that the packaging is intact. Before signing the accompanying document, please make sure that the packaging of the goods is intact. Claims will not be satisfied later. The returned goods must be unused, complete and in the original packaging, the packaging must not be broken or damaged. In order to ascertain the nature, characteristics and functioning of the item, the Buyer must handle and use the goods only as he would normally be allowed to do in the shop.

3) In order to return the Goods, an application for withdrawal from the purchase of the Goods must be submitted, which may be submitted in a free form and sent to the address info@kaisakuunlad.ee no later than within 14 days of receipt of the Goods.

4) The buyer must return the goods to kaisakuunlad.ee online store immediately after submitting the application or no later than within the next 14 days, or submit a certificate that he has handed over the goods to the logistics company during the before mentioned period.

5) Upon receipt of the withdrawal application, the online store kaisakuunlad.ee shall return the amount paid for the goods to the Buyer immediately, but not later than after 14 days.

6) In order to return the product, a withdrawal notice must be sent to the e-mail address info@kaisakuunlad.ee.

8. FORCE MAJEURE

1) Kaisakuunlad.ee online store is not liable for damages caused to the Buyer or delay in delivery of the goods if the damage or delay in delivery of the goods is due to circumstances which online store kaisakuunlad.ee could not influence or foresee.

9. PROCEDURE FOR SUBMITTING CLAIMS

1) The 2-year term for submission of a claim provided for in § 218 (2) of the VÕS applies to products sold by the online store kaisakuunlad.ee.

2) In the event of a defect, the Buyer must submit a claim to kaisakuunlad.ee no later than within two months of the defect occurring, attaching a digital or paper invoice on the basis of which the purchase of the goods was paid for.

3) The online store kaisakuunlad.ee is not responsible

– fault on the behalf of the purchaser due to defects in the product resulting from non-compliance with the instructions for use of the product, improper or improper use and storage of the product,

– for normal wear and tear of the product.

4) In case of non-compliance or defects of the product, please send a complaint to the e-mail address info@kaisakuunlad.ee, stating the name of the customer, contact telephone number, order number and a precise description of the non-compliance or defect of the product.

5) All claims will be reviewed and the Buyer will be contacted as soon as possible, but not later than within 14 days from the receipt of the claim.

10. BUYER’S RIGHT TO CONTACT THE EUROPEAN UNION CONSUMER DISPUTE PLATFORM

1) If the buyer has complaints regarding the online store, they must be sent to the e-mail address info@kaisakuunlad.ee

2) If the buyer and the online store are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The procedural conditions can be viewed and the application submitted HERE. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the online store. The review of the buyer’s complaint in the commission is free of charge.

3) The buyer may turn to the European Union Consumer Dispute Resolution Platform.
